Welcome to Scenescape, a horticultural institution, nursery, landscaping firm and online/offline plant retail business operated by M/s Scenescape Partners, a registered partnership firm based in Patna, Bihar.
This summary explains the key terms in simple language. It is meant to help customers, clients, visitors, online buyers, project clients, institutions, architects, contractors and plant collectors understand the main rules. The detailed legal Terms & Conditions appear after this summary and will prevail if there is any difference.
1. Who We Are
Scenescape is operated by M/s Scenescape Partners, a registered partnership firm. Scenescape is engaged in landscaping, horticulture, nursery operations, rare plant collection, retail and wholesale sale of plants, online sale of plants and horticultural supplies, garden design, plantation work, exterior design, project execution and related services.

2. What These Terms Cover
These Terms apply whenever you:
buy plants or horticultural supplies from Scenescape;
use the Scenescape website or online shop;
place an order by phone, WhatsApp, email, social media, website or in person;
visit the nursery or project site;
book a consultation, appointment, design service or landscaping service;
accept a quotation, estimate, proposal, invoice, work order or purchase order;
engage Scenescape for landscaping, plantation, maintenance, exterior design, nursery supply or horticultural work.
Separate written quotations, tenders, contracts, purchase orders or project agreements may contain additional terms. For project work, those written terms will also apply.
3. Plants Are Living Products
Plants are living, perishable and sensitive to heat, cold, sunlight, watering, humidity, soil, pest, disease, transport stress and customer handling. Photographs on the website or catalogue are representative. The actual plant may differ in size, colour, shape, leaf count, variegation, branching, root development or seasonal appearance.
Scenescape will make reasonable efforts to supply healthy plants, but it cannot guarantee that every plant will look identical to a photograph or remain healthy after delivery if not handled properly.
4. Online and Offline Sales
Orders may be accepted through the website, nursery, phone, WhatsApp, email, social media or sales staff. An order is confirmed only after Scenescape accepts the order and receives payment or confirms approved credit terms.
Prices may change without prior notice. Stock availability may change quickly because plants are living inventory. If a plant becomes unavailable, Scenescape may offer a substitute, credit, revised delivery date or refund for the unavailable item.
5. Shipping and Delivery
Scenescape may deliver plants and supplies locally, nationally or internationally where legally and practically possible. Delivery time depends on plant readiness, weather, packing, courier availability, transport conditions, permits and destination restrictions.
Plants may experience normal shipping stress. Some yellowing, minor leaf damage, soil displacement, dehydration, pruning, trimming or temporary dormancy may happen during transit and will not automatically mean the plant is defective.
Customers must inspect the parcel immediately on delivery and share clear photographs/videos of damage, dead-on-arrival plants or missing items within the time stated in the detailed Terms.
6. Returns, Cancellations and Refunds
Because plants are living and perishable, returns and cancellations are limited. Live plants, custom orders, rare plants, imported plants, project plants, made-to-order planters, opened soil/media/fertilizer/pesticide products and discounted items may not be returnable unless Scenescape specifically agrees.
Refunds or replacements may be considered only for genuine cases such as wrong item, dead-on-arrival, major transit damage, duplicate payment or item unavailability, subject to evidence and verification.
7. Landscaping and Project Work
For landscaping, plantation, garden design, exterior design and project work, Scenescape may provide drawings, concepts, estimates, BOQs, quotations, designs, specifications and execution plans. These are based on the information available at the time.
Final cost and timelines may change due to site conditions, soil, water, drainage, civil works, labour availability, weather, client changes, statutory permissions, design revisions, additional work or variation orders.
Plants supplied for projects may need proper watering, shade, staking, pest control, fertilisation and maintenance after installation. Unless a written maintenance contract is signed, post-installation maintenance is the client’s responsibility.
8. Plant Survival and Warranty
Scenescape does not provide an unlimited survival guarantee for plants. Any plant warranty or replacement obligation must be specifically stated in writing.
Plant mortality caused by improper watering, overwatering, underwatering, heat stress, lack of shade, poor drainage, unsuitable soil, pest attack, disease, client negligence, animal damage, theft, vandalism, construction activity, chemical exposure, force majeure or absence of maintenance will not be Scenescape’s responsibility.
9. Site Safety and Client Responsibilities
For landscaping projects, the client must provide safe site access, water, electricity where needed, storage space, permissions, site readiness, boundary access, drainage information, drawings, underground utility information and timely decisions. Delays caused by the client may extend timelines and increase costs.
Scenescape may suspend work if the site is unsafe, payments are delayed, approvals are pending, or client-side obligations are not fulfilled.
10. Rare, Protected and Regulated Plants
Certain plants may be subject to Indian forest, biodiversity, phytosanitary, import/export, quarantine, CITES, wildlife, customs or other legal restrictions. Scenescape will not knowingly sell illegal plants. Customers are responsible for ensuring that they are legally permitted to receive, possess, transport or import plants in their location.
International shipping may require phytosanitary certificates, customs clearance and import permits. These may involve extra costs and delays.
11. Designs and Intellectual Property
Scenescape’s designs, drawings, concepts, plant palettes, proposals, presentations, photographs, branding, website content and project plans belong to Scenescape unless expressly agreed otherwise in writing.
Clients may use approved designs only for the project for which Scenescape was engaged. They cannot copy, reuse, modify, publish or give Scenescape’s designs to another contractor without written permission.
12. Privacy and Data
When you use the website, place an order, make payment, request a quotation, book an appointment or contact Scenescape, we may collect basic personal data such as name, phone number, email, address, billing details, payment details, plant preferences and communication history. This data is used for orders, delivery, invoicing, customer support, marketing where permitted, legal compliance and service improvement.

B. Full Legal Terms & Conditions
1. Identity of the Business
1.1. These Terms & Conditions govern the use of the website, online store, offline store, nursery, consultations, landscaping services, horticultural services, project services, plant sales, retail sales, wholesale sales, supply contracts and related services operated under the brand name “Scenescape”.
1.2. Scenescape is operated by M/s Scenescape Partners, a registered partnership firm.

1.4. In these Terms, the words “Scenescape”, “Firm”, “we”, “us” and “our” refer to M/s Scenescape Partners. The words “Customer”, “Client”, “Buyer”, “User”, “Visitor”, “you” and “your” refer to any person, firm, company, institution, government body, contractor, architect, consultant, buyer, website user or project client using or purchasing Scenescape’s goods or services.
2. Scope and Acceptance
2.1. By accessing the website, browsing products, placing an order, visiting the nursery, purchasing plants or supplies, making payment, booking an appointment, requesting a quotation, accepting a proposal, signing a work order, issuing a purchase order, engaging Scenescape for landscaping or otherwise using Scenescape’s services, you agree to be bound by these Terms.
2.2. These Terms apply to:
a. online sale of plants and horticultural supplies;
b. offline nursery sales;
c. wholesale plant sales;
d. rare plant sales;
e. landscaping services;
f. plantation work;
g. garden design and exterior design;
h. project execution;
i. maintenance services;
j. horticultural consultation;
k. appointments, site visits and nursery visits;
l. institutional, corporate, government and private contracts;
m. all related website and digital services.
2.3. These Terms shall be read together with invoices, quotations, estimates, purchase orders, work orders, tender documents, project contracts, delivery notes, tax invoices, privacy policies, shipping policies, refund policies and written correspondence issued or accepted by Scenescape.
2.4. In case of conflict between these general Terms and a specific signed contract, tender condition, work order or purchase order accepted by Scenescape in writing, the specific written contract shall prevail to the extent of such conflict.
3. Nature of Products and Services
3.1. Scenescape deals in living plants, nursery products, horticultural supplies, landscaping services and related services. The nature of such goods and services is materially different from ordinary manufactured goods.
3.2. Plants are living organisms. Their appearance, health and growth depend on environmental and human factors including sunlight, shade, watering, humidity, temperature, drainage, air circulation, soil, potting mix, pest control, fertilisation, pruning, transplanting, handling, transport stress and aftercare.
3.3. Photographs, descriptions, catalogues, labels, size references, age references and variety references are provided in good faith. However, actual plants may vary in colour, size, shape, leaf count, flowering, variegation, branching, root development, maturity, seasonal condition and overall appearance.
3.4. Minor differences between photographs and actual plants shall not constitute defect, misrepresentation or deficiency in service.
3.5. Scenescape may classify plants by botanical name, common name, cultivar, variety, trade name or internal nursery category. Taxonomic names may change over time due to scientific reclassification. Such change shall not affect the validity of sale.
4. Website Use and Account Responsibilities
4.1. The Scenescape website may allow users to browse products, view plant categories, place orders, create accounts, manage wishlists, make payments, book appointments, request services, contact the business and access content.
4.2. You agree to provide accurate, complete and current information while creating an account, placing an order, requesting delivery, submitting forms, making payments or communicating with Scenescape.
4.3. You are responsible for maintaining confidentiality of your login credentials, OTPs and account access. Any activity through your account shall be treated as authorised unless you promptly notify Scenescape of misuse.
4.4. You must not misuse the website, attempt unauthorised access, scrape data, overload servers, upload malware, reverse engineer the website, interfere with security features, impersonate another person, manipulate prices, misuse coupons, conduct fraudulent transactions or use the website for unlawful purposes.
4.5. Scenescape may suspend or terminate website access or cancel orders if it reasonably suspects fraud, misuse, unauthorised resale, payment irregularity, abuse, unlawful conduct or breach of these Terms.
5. Orders, Acceptance and Availability
5.1. An order placed through the website, phone, WhatsApp, email, social media, sales representative or nursery staff is an offer to purchase. Scenescape’s acceptance occurs only when the order is confirmed and payment is received or credit terms are approved in writing.
5.2. All orders are subject to availability. Live plant inventory may change quickly due to sales, weather, pest treatment, quarantine, pruning, health inspection, growth stage or project allocation.
5.3. Scenescape may refuse, cancel or modify any order where:
a. the product is unavailable;
b. the plant is not in saleable condition;
c. the displayed price or description contains an error;
d. payment fails or is reversed;
e. the delivery location is unsuitable or legally restricted;
f. the order appears fraudulent or commercially abusive;
g. dispatch may endanger the plant due to weather or transport conditions;
h. legal or regulatory compliance requires cancellation.
5.4. In case of genuine unavailability after payment, Scenescape may offer a substitute, revised dispatch date, store credit or refund for the unavailable item.
6. Pricing, Taxes and Payments
6.1. Prices may be displayed online, quoted in writing or communicated by authorised representatives. Prices may change without prior notice unless a written quotation with validity period has been issued.
6.2. Unless expressly stated otherwise, prices may exclude GST, packing, shipping, loading, unloading, transportation, insurance, phytosanitary certification, customs duty, import/export documentation, installation, civil work, maintenance, site preparation and other incidental charges.
6.3. GST shall be charged as applicable under law. A tax invoice may be issued where required and where accurate billing details are provided.
6.4. Payment may be accepted through cash, bank transfer, UPI, debit/credit card, payment gateway, cheque, demand draft or other approved method, subject to Scenescape’s discretion.
6.5. Online payments may be processed by third-party payment processors, banks, card networks, UPI providers or payment gateways. Scenescape is not responsible for payment gateway downtime, bank delay, failed transactions, duplicate debit or chargeback processing delay, but will reasonably assist in reconciliation upon receipt of proof.
6.6. Cheque payments shall be treated as received only after successful clearance. Any dishonour, chargeback, reversal or failed payment may result in cancellation, suspension of delivery, interest, recovery charges and legal action.
7. Shipping, Packing and Delivery of Plants
7.1. Scenescape may arrange shipping or delivery through its own staff, third-party couriers, transporters, logistics providers, customer-appointed transporters or other available channels.
7.2. Delivery timelines are estimates and not guaranteed unless expressly stated in writing. Delivery may be affected by weather, heat, cold, rain, lockdown, road condition, strikes, courier delay, transport disruption, phytosanitary checks, customs, documentation, government restrictions or force majeure events.
7.3. Plants may be shipped bare-root, semi-bare-root, potted, trimmed, pruned, wrapped, staked, boxed or packed in a manner considered appropriate by Scenescape.
7.4. Normal transport stress may include minor leaf yellowing, leaf drop, bruising, soil displacement, broken small leaves, dehydration, wilting, temporary dormancy, pruning marks or cosmetic damage. Such normal stress shall not by itself be treated as a defect.
7.5. Risk in the products shall pass to the customer upon delivery to the customer, customer’s representative, security guard, receiving clerk, courier, transporter or delivery address provided by the customer, unless otherwise agreed in writing.
7.6. If a customer provides an incorrect address, unavailable contact number, wrong pin code, inaccessible delivery location or refuses delivery, Scenescape shall not be liable for plant deterioration, re-delivery charges, courier return, storage damage or loss.
7.7. Customers must not delay unpacking. Plants should be opened carefully and acclimatised as per instructions. Delay in unpacking may void any claim for damage or dead-on-arrival.
8. Inspection, Damage Claims and Dead-on-Arrival Claims
8.1. The customer must inspect all plants, supplies and goods immediately upon delivery.
8.2. Any claim for dead-on-arrival, major transit damage, wrong item or missing item must be submitted within 24 hours of delivery, unless a different period is stated in writing.
8.3. Claims must include:
a. order number or invoice number;
b. clear photographs and videos of the sealed package before opening, where possible;
c. photographs/videos during unpacking, where possible;
d. photographs of the plant, roots, packaging and label;
e. delivery date and time;
f. description of the issue.
8.4. Scenescape may reject claims that are late, unsupported, unclear, caused by improper handling, caused by delayed unpacking, caused by customer negligence, or relate only to normal transport stress.
8.5. If Scenescape accepts a claim, it may, at its discretion, offer replacement, partial credit, store credit, refund or technical aftercare advice.
8.6. Replacement shall be subject to availability of the same or similar plant. Rare plants, one-of-a-kind specimens, imported plants and collector plants may not be replaceable.
9. Returns, Exchange, Cancellation and Refunds
9.1. Because plants are living, perishable and sensitive products, live plants are generally non-returnable and non-refundable once dispatched, delivered, collected or handed over.
9.2. The following items are generally not eligible for return or cancellation unless Scenescape agrees in writing:
a. live plants;
b. rare, collector, imported or one-of-a-kind plants;
c. custom-grown or reserved plants;
d. bulk plant orders;
e. project-specific plants;
f. plants pruned, packed or prepared for dispatch;
g. opened soil, potting media, fertiliser, pesticide or chemical products;
h. made-to-order planters, pots, stands or garden products;
i. discounted, clearance or sale items;
j. items damaged due to customer handling.
9.3. Orders may not be cancelled after confirmation if procurement, reservation, packing, pruning, dispatch preparation, customisation or project allocation has begun.
9.4. If cancellation is permitted before dispatch, Scenescape may deduct payment gateway charges, packing cost, procurement cost, reservation cost, administrative charges and other actual costs.
9.5. Refunds, where approved, may be processed to the original payment method or as store credit, at Scenescape’s discretion and subject to applicable law.
9.6. Refund timelines depend on banks, payment gateways and internal verification. Scenescape shall not be responsible for delays caused by third-party payment processors.
10. Nursery Visits, Appointments and Site Visits
10.1. Nursery visits, consultations, rare plant viewing and meetings may require prior appointment.
10.2. Visitors must follow nursery instructions, not enter restricted areas, not touch rare plants without permission, not remove labels, not take cuttings, seeds, offsets, pups or plant material, and not disturb nursery operations.
10.3. Children must be supervised. Visitors shall be responsible for their belongings, personal safety and conduct.
10.4. Photography or videography inside the nursery may be restricted, especially for rare collections, propagation areas, client material, proprietary layouts or security reasons.
10.5. Scenescape may refuse or terminate a visit for misconduct, unsafe behaviour, unauthorised photography, attempted theft of plant material, nuisance or breach of instructions.
11. Landscaping, Garden Design and Project Services
11.1. Scenescape may provide landscaping, garden design, exterior design, plantation, nursery supply, plant installation, horticultural consultation, maintenance and related project services.
11.2. Project services may be governed by proposal, quotation, work order, purchase order, tender document, BOQ, drawings, specifications, site instructions or separate agreement.
11.3. Unless expressly included, Scenescape’s scope shall not include civil construction, waterproofing, structural work, plumbing, electrical work, drainage correction, soil testing, irrigation automation, pest-control contracts, earthwork, government approvals, municipal permissions, borewell work, boundary wall, hardscape construction or long-term maintenance.
11.4. Any design, estimate or BOQ prepared before detailed site investigation shall be preliminary and subject to revision after site measurement, soil condition, access, drainage, client requirements and execution constraints are assessed.
11.5. Quantities in landscaping are estimates. Actual quantities may vary due to site conditions, wastage, plant spacing, survival replacement, design changes, terrain, soil levels and client instructions.
11.6. Any additional work, change in specification, change in plant palette, extra quantity, rework, acceleration, night work, additional visit, design revision or client-requested modification shall be chargeable as a variation unless expressly included in the original written scope.
12. Client Obligations for Projects
12.1. For landscaping and project work, the client shall provide:
a. lawful access to the site;
b. accurate site drawings and measurements, if available;
c. information on underground utilities, drainage, cables, pipelines and structural restrictions;
d. water and electricity where required;
e. safe working conditions;
f. storage space for plants, tools and materials;
g. necessary permissions from owners, societies, authorities or project managers;
h. timely approvals for drawings, plant selections and materials;
i. timely payments as per agreed milestones;
j. protection of installed plants from theft, vandalism, animals, labour damage and construction activity.
12.2. Delay or failure by the client to fulfil obligations may result in timeline extension, cost escalation, suspension of work or deterioration of plants kept on site.
12.3. If plants supplied or installed by Scenescape are damaged by other contractors, site labour, animals, vehicles, construction debris, chemical exposure, waterlogging, fire, theft, vandalism or client negligence, replacement shall be chargeable.
13. Timelines and Delays in Project Work
13.1. Project timelines are estimates unless expressly described as binding in a signed contract.
13.2. Timelines may be extended due to weather, extreme heat, rain, flooding, site unavailability, labour shortage, delayed payment, delayed approvals, material shortage, plant availability, transport delay, civil work delay, design change, third-party delay, government restriction or force majeure.
13.3. Scenescape shall not be liable for delay caused by circumstances beyond its reasonable control.
13.4. If the client delays site handover, payment, approval or decision, Scenescape may revise the project timeline and cost.
14. Plant Survival, Maintenance and Warranty in Project Work
14.1. Plant survival depends on post-installation care. Unless a written maintenance contract is executed, Scenescape does not assume responsibility for ongoing watering, pruning, fertilisation, pest control, shade management, acclimatisation or replacement after installation.
14.2. Any plant warranty must be expressly stated in writing. Verbal statements shall not create a survival guarantee.
14.3. Even where a limited warranty is provided, it shall not apply to mortality or damage caused by:
a. overwatering or underwatering;
b. inadequate drainage;
c. excessive heat, frost, wind or rain;
d. unsuitable soil or water quality not caused by Scenescape;
e. pest or disease after handover;
f. client negligence or lack of maintenance;
g. animals, theft, vandalism or third-party damage;
h. construction activity, dust, cement, paint, chemical or debris exposure;
i. relocation or repotting by the client;
j. force majeure;
k. failure to follow care instructions.
14.4. Replacement of dead plants, if agreed, shall be limited to the specific warranty terms and shall not include labour, transport or repeated replacements unless expressly agreed.
15. Maintenance Contracts
15.1. Maintenance services, where provided, may include watering supervision, pruning, fertilisation, pest inspection, plant health checks, seasonal replacement advice and related horticultural care as per written scope.
15.2. Maintenance contracts do not automatically include free replacement of dead plants, supply of new plants, pest-control chemicals, fertilisers, soil, pots, irrigation repairs, civil repairs or emergency visits unless specifically included.
15.3. The client shall provide water, electricity, access, storage and safe working conditions for maintenance staff.
15.4. Maintenance may be suspended for non-payment, unsafe site conditions, lack of access or client interference.
16. Rare Plants, Protected Species and Legal Compliance
16.1. Scenescape may deal in rare, collector, exotic, imported, propagated or unusual plants. Some species may be subject to Indian or international legal restrictions.
16.2. Scenescape does not knowingly trade in plants prohibited by law.
16.3. The customer is responsible for ensuring that possession, transport, import, export or cultivation of a plant is lawful in the customer’s jurisdiction.
16.4. For interstate or international orders, the customer may be required to obtain import permits, quarantine approvals, phytosanitary certificates, customs clearance or other permissions. Such costs and responsibilities shall be borne by the customer unless expressly agreed otherwise.
16.5. International shipments may be delayed, inspected, confiscated, returned or destroyed by customs, quarantine or other authorities. Scenescape shall not be liable for such action where it arises from destination-country restrictions, customer’s failure to obtain permissions or authority decisions beyond Scenescape’s control.
17. Horticultural Advice and Care Guidance
17.1. Scenescape may provide care guidance, plant advice, horticultural recommendations, watering advice, media suggestions, fertiliser suggestions, pest-control advice and acclimatisation instructions.
17.2. Such advice is based on information provided by the customer and general horticultural experience. It is not a guarantee of plant survival or performance.
17.3. Customers must adapt advice to their local climate, water quality, light, humidity, ventilation, pot, soil and maintenance practices.
17.4. Misapplication of fertilisers, pesticides, chemicals, media, watering schedules or sunlight exposure may harm plants. Scenescape shall not be liable for loss caused by incorrect implementation or conditions outside its control.
18. Product Descriptions, Images and Representation
18.1. Product photographs may show mother plants, representative plants, mature specimens, seasonal appearance, nursery stock, batch examples or previously sold specimens.
18.2. Unless a specific plant is marked as “exact plant” or “same plant as shown”, the customer understands that the delivered plant may differ from photographs.
18.3. Plant size may be described by pot size, approximate height, spread, age, leaf count, caudex size, trunk size or nursery grade. Such measurements are approximate.
18.4. Variegation, colour, flowering and growth pattern may change over time and may not remain identical after delivery.
19. Intellectual Property and Use of Designs
19.1. All intellectual property belonging to Scenescape, including the name Scenescape, logo, website content, product photographs, nursery photographs, plant collection photographs, designs, drawings, concepts, plant palettes, presentations, BOQs, project proposals, landscape plans, technical notes, branding, packaging designs and social media content, is owned by or licensed to Scenescape.
19.2. No customer or client may copy, reproduce, modify, publish, commercially exploit, resell, share, reverse engineer or provide Scenescape’s designs or documents to another contractor without prior written permission.
19.3. Payment for design or project services does not transfer copyright or intellectual property unless expressly stated in writing.
19.4. A client may use approved designs only for the specific site and project for which Scenescape was engaged.
19.5. If a client uses Scenescape’s design without engaging Scenescape for execution, Scenescape shall not be responsible for results, plant failure, site issues, implementation defects or contractor errors.
20. Photography, Portfolio Use and Publicity
20.1. Scenescape may photograph or record its nursery, plants, landscaping projects, installation process, completed works and before-after transformations for internal records, quality control, portfolio, website, social media and marketing.
20.2. For private residences, Scenescape shall use reasonable discretion and avoid publishing sensitive personal details unless consent is obtained or the content is already public.
20.3. For institutional, commercial, government or public-facing projects, Scenescape may refer to the project in its credentials, portfolio, presentations and marketing unless prohibited by a written confidentiality clause.
20.4. Clients shall not use Scenescape’s name, logo, photographs, designs or project images in a misleading manner.
21. Confidentiality
21.1. Where Scenescape receives confidential project information, drawings, financial information, tender information, private residence details or business plans, it shall take reasonable care to keep such information confidential.
21.2. Confidentiality shall not apply to information that is public, already known, independently developed, required for legal compliance, required for execution through employees or subcontractors, or required to be disclosed by law or authority.
21.3. The client shall not disclose Scenescape’s confidential pricing, designs, proprietary plant sourcing, supplier information, project methods or technical proposals to competitors or unauthorised third parties.
22. Subcontractors, Vendors and Third Parties
22.1. Scenescape may engage employees, labourers, consultants, designers, horticulturists, transporters, couriers, vendors, subcontractors or specialists for execution of work.
22.2. Scenescape shall be responsible for coordination of its appointed personnel, subject to agreed scope and payment.
22.3. Where the client directly appoints other contractors, vendors or consultants, Scenescape shall not be liable for their acts, omissions, delays, damage or defective work.
22.4. If third-party work affects Scenescape’s work, Scenescape may seek extension of time, additional payment or revision of scope.
23. Safety, Site Conduct and Risk
23.1. Both Scenescape and the client shall cooperate to maintain safe working conditions.
23.2. The client must disclose hazards including electrical lines, underground cables, water lines, weak slabs, chemical storage, animals, unstable soil, unsafe structures, restricted areas and security requirements.
23.3. Scenescape may refuse or suspend work at an unsafe site.
23.4. The client shall ensure that Scenescape’s plants, tools, equipment and materials stored at site are protected from theft, damage, animals, rain, construction debris and unauthorised handling.
23.5. Scenescape shall not be responsible for loss or injury caused by client-side unsafe conditions, undisclosed hazards or interference by third parties.
24. Government, Tender and Institutional Work
24.1. For government, public sector, institutional, corporate or tender work, the tender document, purchase order, work order, contract agreement, technical specification, schedule of quantities and applicable procurement terms shall apply in addition to these Terms.
24.2. Scenescape shall be entitled to payment for work done, materials supplied, plants reserved, plants delivered, plants installed and services performed as per applicable contract terms.
24.3. Any retention, security deposit, performance guarantee, defect liability, penalty, liquidated damages or inspection mechanism shall apply only if expressly agreed in the relevant written contract.
24.4. In case of any ambiguity, commercially reasonable interpretation consistent with horticultural realities, site conditions and living nature of plants shall be preferred.
25. Employment, Jobs and Applications
25.1. Any job application, employment inquiry, internship request, contractor inquiry or vendor inquiry submitted through the website or otherwise does not create an employment, partnership, agency or engagement relationship.
25.2. Scenescape may collect applicant data for recruitment and may retain it for future opportunities unless deletion is requested, subject to applicable law.
25.3. Scenescape may reject any application without assigning reasons.
26. Data Protection, Privacy and Digital Personal Data
26.1. Scenescape may collect and process personal data including name, phone number, email address, billing address, shipping address, GST details, payment status, transaction history, order history, plant preferences, site address, project details, communication records, photographs shared by customers, website usage data, cookies, device information and IP address.
26.2. Personal data may be processed for:
a. order processing;
b. delivery and shipping;
c. invoicing and tax compliance;
d. payment confirmation;
e. customer support;
f. appointment scheduling;
g. project estimation and execution;
h. warranty or complaint handling;
i. legal compliance;
j. fraud prevention;
k. service improvement;
l. marketing communications where permitted;
m. record keeping and dispute resolution.
26.3. Where consent is required under applicable law, Scenescape shall seek consent. By voluntarily submitting information for an order, quotation, appointment, delivery or service request, the customer authorises Scenescape to process such information for the requested purpose.
26.4. Scenescape may share necessary data with payment gateways, banks, logistics providers, courier partners, accountants, tax consultants, IT service providers, hosting providers, customer support tools, legal advisors, government authorities, subcontractors and service providers, strictly to the extent necessary for legitimate business, legal or service purposes.
26.5. Scenescape shall take reasonable security measures to protect personal data. However, no digital system is completely immune from risk, and Scenescape shall not be liable for unauthorised access caused by customer negligence, compromised devices, third-party breaches or circumstances beyond reasonable control, except where liability cannot be excluded under law.
26.6. Customers may request access, correction, updating, deletion, withdrawal of consent or grievance redressal as available under applicable Indian law, subject to retention required for tax, accounting, legal claims, fraud prevention, dispute resolution and statutory compliance.

27. Cookies, Analytics and Digital Tools

29.2. Scenescape does not control third-party platforms and is not responsible for their content, downtime, privacy practices, terms, errors or actions.
29.3. Use of third-party platforms is subject to their respective terms and policies.
30. Limitation of Liability
30.1. To the maximum extent permitted by law, Scenescape shall not be liable for indirect, incidental, special, punitive or consequential losses, including loss of profit, loss of opportunity, loss of business, loss of goodwill, emotional distress, loss due to project delay, plant mortality after handover, travel cost, accommodation cost, data loss or reputational loss.
30.2. Scenescape shall not be liable for loss caused by:
a. customer negligence;
b. incorrect care;
c. delayed unpacking;
d. wrong address;
e. courier delay;
f. weather or climate;
g. pest, disease or infection after delivery;
h. improper watering or sunlight exposure;
i. construction activity;
j. third-party contractor damage;
k. force majeure;
l. legal restrictions at destination;
m. customer’s failure to obtain permits;
n. misuse of products;
o. reliance on general advice without adapting to local conditions.
30.3. Subject to applicable law, Scenescape’s aggregate liability for any product shall not exceed the amount paid for that product.
30.4. For project services, subject to applicable law and any specific written contract, Scenescape’s aggregate liability shall not exceed the amount paid to Scenescape for the specific portion of work giving rise to the claim.
30.5. Nothing in these Terms shall exclude liability that cannot be excluded under Indian law.
31. Indemnity
31.1. You agree to indemnify and hold harmless Scenescape Partners, its partners, employees, consultants, contractors, agents, vendors and representatives from claims, losses, damages, penalties, costs and expenses arising from:
a. your breach of these Terms;
b. incorrect information supplied by you;
c. misuse of plants, products, designs or advice;
d. violation of law;
e. unauthorised use of Scenescape’s intellectual property;
f. damage caused at site by you or your contractors;
g. failure to obtain permits;
h. unsafe site conditions;
i. claims by third parties arising from your actions.
32. Force Majeure
32.1. Scenescape shall not be liable for failure, delay, cancellation, deterioration, plant mortality, non-delivery or partial performance caused by events beyond its reasonable control.
32.2. Force majeure events include excessive heat, cold, rain, storm, flood, drought, fire, pest outbreak, disease outbreak, epidemic, pandemic, transport disruption, labour shortage, strike, riot, war, government order, customs action, quarantine action, internet failure, payment gateway failure, supplier failure, courier failure, fuel shortage, natural calamity, accident or other events beyond reasonable control.
32.3. In such cases, Scenescape may extend timelines, revise delivery, substitute products, suspend work, cancel affected orders or take commercially reasonable steps.
33. Suspension and Termination
33.1. Scenescape may suspend or terminate services, cancel orders, stop delivery or halt project work if:
a. payment is delayed;
b. the client breaches terms;
c. the site is unsafe;
d. required approvals are not provided;
e. the client is abusive or threatening;
f. fraudulent activity is suspected;
g. legal compliance requires suspension;
h. continued performance is commercially or horticulturally impractical.
33.2. Suspension shall not waive Scenescape’s right to recover dues for goods supplied, services performed, plants reserved, work completed, costs incurred and damages suffered.
34. Grievance, Support and Complaints
34.1. Customers may raise grievances, product issues, privacy requests, delivery issues, billing queries or project concerns through:

34.2. Complaints should include order number, invoice number, delivery date, photographs, videos, payment proof and a clear description of the issue.
34.3. Scenescape will make reasonable efforts to respond within a commercially reasonable period, depending on the nature of the issue.
35. Governing Law and Jurisdiction
35.1. These Terms shall be governed by the laws of India.
35.2. Subject to statutory consumer rights and any forum whose jurisdiction cannot be excluded by contract, the courts and competent forums at Patna, Bihar, India shall have jurisdiction over disputes arising from or relating to these Terms, Scenescape’s website, products, services, orders, projects or transactions.
36. Changes to These Terms
36.1. Scenescape may update, revise or replace these Terms from time to time for legal, operational, horticultural, technical, commercial or policy reasons.
36.2. Updated Terms may be posted on the website or communicated through appropriate channels. Continued use of Scenescape’s website, products or services after such update shall constitute acceptance of the revised Terms.
37. Severability and No Waiver
37.1. If any provision of these Terms is found invalid, illegal or unenforceable, the remaining provisions shall continue to remain valid and enforceable.
37.2. Failure by Scenescape to enforce any provision shall not constitute waiver of its right to enforce that provision later.
38. Entire Understanding
38.1. These Terms, together with quotations, invoices, proposals, project agreements, privacy policies, shipping policies, refund policies, written communications and accepted work orders, constitute the understanding between Scenescape and the customer/client.
38.2. No verbal assurance, informal message, social media statement or casual conversation shall override written terms unless confirmed by Scenescape in writing through an authorised representative.
